With reference to HT’s report on page 8 of September 1, 2011, headlined “Cops to resume probe in data theft case”, Sundaram BNP Paribas Home Finance Ltd says: “The company is surprised that you have not checked with the company before publishing the story in your esteemed publication and that you have gone ahead giving just one side of the story.

“Company sources said that its new software was developed by its group IT company with more than two decades’ experience in developing loan software and Kensoft has suppressed the fact from you that Anna University, Chennai, had officially certified that there was no copyright violation, whatsoever. Besides, the reference to the so-called certificate from IIT, Mumbai, is wrong, as IIT has since clarified that they do not officially give such certificates or
opinion. “It is a malicious and vexatious complaint filed by Kensoft mischievously in Mumbai outside the applicable jurisdiction and the company has already obtained a stay against the single judge’s judgement at Madras high court recently.”

The Madras high court lifted the stay last week and police have resumed investigation. The chief of the Mumbai police’s crime branch, Himanshu Roy, confirmed this on record. The allegation against Sundaram Finance Ltd is not in the form of a complaint, but is contained in a first information report that Mumbai police’s cyber crime cell registered after finding primary evidence. Cyber crime’s senior inspector, Nandkumar More, has been quoted in the report.
